• You shall not approach any law enforcement, tribunal, or judicial body against EliteDigitalMart.online for any reason related to data, services, or transactions.

5. No Liability Clause

To the fullest extent permitted by law, you agree and acknowledge:

• EliteDigitalMart.online is not liable under any Indian or foreign data protection laws.
• We do not act as a Data Fiduciary or Controller under the DPDP Act or GDPR.
• You are solely and fully responsible for:
  • The legality of the services you request
  • The consequences of sharing your data
  • All risks, damages, penalties, or investigation that may follow

6. Indemnity & Legal Protection

You agree to indemnify and compensate EliteDigitalMart.online as follows:

• If your use of the platform results in any investigation, complaint, lawsuit, penalty, defamation, FIR, raid, or notice, you agree to bear full legal and financial responsibility.
• You shall pay ₹10,00,000 (Ten Lakh Rupees) as liquidated damages to EliteDigitalMart.online for any such event, regardless of outcome.
• This clause is enforceable in Indian civil and criminal courts, and you waive your right to contest the sum or the terms.

7. Legal Waivers

You permanently waive any right to:

• File complaints with government authorities or courts against us for data-related matters.
• Demand deletion, export, or access to data once shared with resellers.
• Cite or rely upon Sections 43A, 66E, 72A of the IT Act or related provisions of the BNS, IPC, or DPDP Act.

All legal risk and exposure belongs entirely to you as the user.

8. Storage and Retention

We retain user data only for the minimum duration necessary to complete order coordination. After this period, it may be deleted, archived, or anonymized.

However, any data already shared with third parties is out of our control and may continue to exist indefinitely.

9. Jurisdiction and Enforceability

This policy is governed under the exclusive jurisdiction of Guwahati Assam, India.

You agree that any dispute or claim must be brought only before the courts of this location.

Any breach of this policy entitles us to injunctive relief, damages, and legal action without notice.

10. Final Declaration

By continuing to use this platform:

• You accept all above clauses unconditionally.
• You agree that EliteDigitalMart.online is not your service provider, but merely a neutral intermediary.
• You fully release us from all responsibility, and accept that you alone will face legal consequences, if any arise, from your data or service usage.
