1. Introduction

By accessing, browsing, or making any use of EliteDigitalMart.online ("we", "our", or "the platform"), you ("you", "the customer", or "user") agree to be fully and unconditionally bound by the Terms outlined herein.

EliteDigitalMart.online does not sell, host, or own any digital service or product listed. We only facilitate connections between independent third-party freelance digital service providers ("resellers") and users. Any purchase or use of services is strictly between you and the service provider.

2. Nature of Operations

We are not a service provider, but a neutral coordination and referral platform.

All products/services (including but not limited to digital tools, content access, social media metrics, or online credentials) are sourced and fulfilled by independent third-party resellers.

You understand and accept that we do not develop, license, own, or guarantee any service listed on this website.

All branding, logos, and references are for identification purposes only, and we disclaim all trademark associations.

3. User Declaration & Legal Responsibility

By using this site, you agree:

• You are 18 years or older, and you are using this platform with full legal consent and awareness.
• You take 100% responsibility for any outcome, legal consequence, account restriction, policy violation, or government action resulting from your use of any service.
• You waive all rights to hold EliteDigitalMart.online or its operators liable under any circumstances.
• You declare that you will not approach any legal authority, police, or government agency for any issue resulting from your usage of third-party services via this platform.
• Any such act will be deemed a direct breach of contract, and all user privileges will be revoked immediately.
• You indemnify us against all damages and accept full legal burden for any issues arising from your purchases or actions.

4. Applicable Legal Framework

This agreement shall be interpreted under Indian law. You, the user, agree to bear sole legal consequences under:

• Information Technology Act, 2000
• Indian Penal Code (IPC) / Bharatiya Nyaya Sanhita, 2023

including but not limited to:

• Section 66F IT Act: Cyber terrorism
• Section 420 IPC/BNS: Cheating and fraud
• Section 120B IPC/BNS: Criminal conspiracy
• Section 43 IT Act: Unauthorized access or misuse

Any violation of terms resulting in complaints, actions, or investigations from government bodies or regulators shall be solely faced by the user, not the platform.

5. Third-Party Data Sharing Consent

By placing an order, you explicitly agree:

• That your name, contact, and order details may be shared with a third-party service provider to fulfill your request.
• That you have read and understood the implications of this sharing, and you voluntarily consent.

6. Service Delivery & Limitations

All services are delivered via external resellers using mediums such as Telegram, WhatsApp, email, or dashboard access.

Delivery times and results are NOT guaranteed, and are outside of our control.

No refunds or cancellations are possible once an order has been initiated with a provider.

7. Dispute Waiver & Support

You agree that any dispute must be raised within 48 hours via our support channel only.

You agree to resolve all issues privately with the service provider or via our escalation team, not through legal or government routes.

EliteDigitalMart.online will not participate in any third-party investigation, claim, refund, or litigation.

8. Financial Disclaimer & Indemnity

Payments are collected for facilitation and handling only, and forwarded to the third-party providers.

We do not collect GST, unless explicitly mentioned in the invoice.

You agree to indemnify EliteDigitalMart.online and its operators up to ₹10,00,000 (ten lakh INR) for any business loss, legal fee, reputation damage, or disruption caused by your use, misuse, or legal actions.

This amount becomes immediately payable upon breach or violation.

This clause survives termination of this agreement.

9. Forbidden Use & Monitoring

You may not:

• Use this site to access illegal or unauthorized services under any country's law.
• Attempt to hold EliteDigitalMart.online responsible for third-party content or results.
• Use false identities or contact methods for fraudulent purchases.

We reserve the right to:

• Suspend or permanently block access without notice.
• Share user information with resellers and, in rare cases, legal teams as required for indemnity.

10. Jurisdiction and Enforceability

This agreement is governed under the laws of India, with jurisdiction in Guwahati Assam.

Any clause deemed unenforceable shall not affect the rest of the agreement.

No waiver of liability shall be interpreted in our disfavor.

11. Final Disclaimer

You fully understand that EliteDigitalMart.online is only a connector and coordination service. You are fully responsible for what you purchase, how you use it, and any consequence arising therefrom.
